✓The increasing incidents of mob lynching have created an atmosphere of fear in society.
✓In this context, the NCRB said that the data presented by the states regarding mob lynching is unbelievable.
✓If we have define democracy by Abraham Lincoln, democracy is"government of the people,by the people,for the people and it shall not perish from the earth.
The basic and most essential feature of a democracy is to protect the life and liberty of the people ,but today 
In the largest democracy of the world,the life and liberty of the people are being infringed upon.
✓mob lynching is an offence to the dignity of the human being, the Constitutional protection U/A-21 and a serious breach of human right.
✓In the year 2018,  the supreme Court of the india described the lunching as a
"Horrendous act of mobocracy".
The court asked the parliament to pass law established lynching as a separate offence with punishment.
 The court also directed the central and state government to frame the laws specifically to deal with the crime of lynching and laid down certain guidelines to be incorporated to include fast track trials,compensation to victim and action against the violators.
✓Rajasthan ,west bengal and manipur came up with bills against lynching.
The case of lynching directed to be tried by the fast track court and shall be concluded with 6 months. The WhatsApp forwarding message has been restricted to only 5 chats,in order to stop the fake rumors to get spread so easily. The police Administration and district administration who failed to comply with the supreme court guidelines will be regarded as deliberate negligence and strict action will be taken against them.
✓Mob lynching is a term used to describe the acts of targeted violence by a large group of people. The violence is tantamount to offences against human body or property - both public as well as private.
✓The mob believes that they are punishing the victim for doing something wrong and they take the law in their own hands to punish the purported accused without following any rules of law.
✓Murder of 3 people, two monks and their driver by a mob in palghar. The mob constituted an unlawful assembly under section 141 of Indian penal code,1860 and police was authorized to use force to disperse that assembly section 129 of the crpc,1973.
Under law, illegal act includes illegal omission (section 32. of India penal code). Police was legally bound to protect the people.
✓In july 2017, the supreme court while pronouncing its judgement in the case of  Tahseen s. Poonamwal V. Union of India 2016, had laid down several preventive, remedial and punitive measure to deal with lunching and mob violence. States were directed to set up
designate fast track courts in every district to exclusively deal with cases involving lynching.
The 2015 dadri mob lynching refers to cases of mob lynching in which a mob of villagers attacked the home of 52 year old Mohammed akhlaq , killing him for suspicious of salaughtering  a cow. The attack took place at night,on 28 September 2015 in bisara village, near dadari , Uttar Pradesh.
✓All human beings are born free and equal in dignity and rights.
✓The word "lunching" originated in the United States in the mid 18th century. Many historians believe that the term was first used by a planter named Charles lunch to describe extra judiciary authority assumed by private individuals.
What do you call this? The inhuman act is called mob lunching.
✓This type of violence does not follow any legal process and completeness is illegal.
✓Some antisocial people see it as related to politics by caste and also with religion and some criminally minded or politician people take advantage of this,
It is not beneficial for our society.
✓Violence in the name of religion and caste is very strong in the country.The incessant incidents of lynchings are mostly the result of hatred towards insolence and other religion and caste.

With modernity, a sense of individualism has developed in us and our social affiliation has decreased due to which we forgot to appreciate diversity.
It is often said that there is no face of the crowd and that is why people present in the crowd do not differentiate between right and wrong.
✓Not arresting the people involved in mob lynching is a big problem of the country or not only exposes the failure of police system but also boosts the morale of criminals.
Ethical conduct of public representatives in India has become a hypothesis, Personal attacks and abusive and hate speech and speeches have become quite common and this speech plays a big role in mob lynching.
✓There is no clear reference to action against incidents like mob lynching in IPC and they are dealt under Section 302 (punishment for murder) ,307(attempt to muder), 323 (punishment for voluntarily causing hurt), 147 ( punishment for rioting), 148 ( rioting,armed with deadly weapon),  149 ( every member unlawful assembly guilty of offence committed in prosecution of common object), 34 (acts done by several persons in furtherance of common intention.) Only.
✓Nothing in this regard has been explicitly stated in code of criminal procedure,1973.
.Incident like mob lynching is totally illegal and unconstitutional, if they are not banned then the public will lose faith in the constitution and judiciary.
✓Article 21 in the Constitution of India gives every person the right to life and mob lynching violates the fundamental rights of the person.
It affects the idea of ​​unity of society and gives rise to a feeling of unrest.
This promotes caste, class and communal hatred in the society.
 ✓The nature of killing and killing by mob is different. These two should be defined differently. 
Murder by mob requires strict law.
To make this world a better place to live, we have to be tolerant toward every caste and creed, every religion , every living creatures instead.
To quote Mahatma Gandhi :-
You must not lose faith in humanity. Humanity is an ocean; if a few drops of the ocean does not become a dirty.

    न्याय व्यवस्था में क्रांतिकारी बदलाव की जरूरत है।जिसमें आम आदमी को त्वरित न्याय सहज उपलब्ध हो। लोगो में कानूनी रूप से जागरूक बने ताकि कानून आपने हाथ में न ले। नैतिक शिक्षा शुरू से ही संस्कार के रूप में मिले। समाज में वैमनस्यता का विष घोलने वाले बयानबाजी को रोका जाए। मीडिया या सोशल मीडिया पर चल रहे जातिगत सांप्रदायिक तथा क्षेत्रीय मतभेदों को भड़काने वाले कार्यक्रम जो की right of speech (artical 19 क) के आड़ में चलते है उन्हें प्रतिबंधित किया जाना चाहिए। मोब लिंचिग में उग्र जनता अपना विवेक खो देती है।जिसका कारण प्रास्थिति जन्य आकस्मिक कारण भी होते है। कुछ मोब लींचिग प्रायोजित होते है दोनों को रोकने के लिए अलग अलग रणनीति पर काम करने की जरूरत है। सब को एक साथ इस समस्या के प्रत्येक पहलू पर विचार करना चाहिए समस्या को किसी समाज या राजनीतिक दल पर अशाहिष्णुता का आरोप प्रत्यारोप लगाने से समाधान नहीं हो पाएगा। इस समाज के निर्माण में सभी व्यक्ति की भागीदारी है । अंत में आशीष के द्वारा लिखे गए आंग्ल भाषा में अत्यंत गंभीर वक्तव्य का मै हृदय से प्रशंसा करता हूं। मेरा आशिर्वाद

    I dont think mob lynching as an instantaneous act ...specially now a days..
    Its a planned events plotted by todays news anchors, polticians and delays in justices..
    These are reflections of all these and it should be dealt in all these aspects.
    No one is considered faulty in case of individually, i dont know why..
    the inspector of the area and DM , SP of that particular area should be held responsible at first glance untill they explain their innocence..
    Today due to poor news anchoring most of people made a judgement much before any judgement comes. There are no one to ask questions to these news agency..i thing this is the field where action should be taken first to stop these kind of inhumane act..
    Mob lynching is surely an inhumane..

    पहली बार असहयोग आंदोलन में ऎसा लगा कि भारत की आजादी मिलने ही वाली है। सन् 1919 में लार्ड चेम्सफोर्ड ने भारत शासन अधिनियम में विश्व युद्ध में भारत के सहयोग के बदले कुछ नहीं दिया।विरोध को दबाने के लिए रॉलेट एक्ट जैसा काला कानून फिर जलियावाला कांड जैसा कांड। पुरा देश इससे आंदोलित था। परन्तु गोरखपुर के चौरीचौरा में हुई एक मोब लींचिंग की घटना से आहत होकर गांधी जी द्वारा देशव्यापी उस महाआंदोलन को समाप्त कर दिया गया और हमें आजादी के लिए लगभग 27साल इंतजार करना पड़ा। यदि इस तरह की घटना आज हुई होती तो क्या वर्तमान सताधारी तथाकथित राष्ट्रवादी इस तरह का निर्णय ले पाते। क्या मीडिया इस घटना को मुख्य खबर बना कर दिन भर चलती। उल्टे चोरी चौरा में हुई घटना में शामिल लोगों को सम्मानित किया जाता क्योंकि लोगो ने थाना को जलाकर अंग्रेजो को मारा था। अहिंसा का रास्ता बहुत कठिन होता है। राम राज्य की कल्पना लोक में जीने वालों को गांधी के अहिंसा के दर्शन को पहले खुद आत्मसात करना पड़ेगा तभी मोब linching की घटनाओं पर रोक लगेगा
