• Article 21 of the Indian constitution(preventing the deprivation of life and liberty save by established legal procedure.)
•it is difficult to run criminal's against fair trail,but is not right to take constitution in hand.
•The court is sitting to punish the colonel(criminal)and not the police. If the police will punish the culprits,then what is the role (work) of the judicial in the society.
•society is not run with the feeling of the people but with a good judicial system and adminstration.

•In this way, every criminal will be afraid to submit himself to the law. And what else does on innocent common man think to be short as a criminal and not able to provide himself
## I do not think to save a criminal or a criminal thinking person; I just wish that a good Justice system in the society.#

ReplyDeleteIt's not the matter of celebration, but following duenpricess of lawnis required to be fulfilled by all the protector of lawand police department is one of them. Sometimes it is seen the police highhandedness is apparent while dealing with life ofnthe criminal ,under the garb of fleeing from the clutch or self defence which is very dangerous for the rule of law. Police is meant to catch hold and handover to the jurisdiction of law i.e judiciary which is their to see the crime and upon analysis in accordance of law punish or convict the accused sometimes bypassing all these procedural trials fairness or credibility of police department is at question and doubtful. But in a civil society it's often sen she general citizen are fed up with the long trial procedure and most of the times in a habitual criminals due to lack or witness or hostile witness the criminals often get free. That's the reason nowadays the police are adopting a system of countering such criminals and the public at large celebrate the occasion saying that he is eleminated ... Both aspect is dangerous . Law should has to be followed in all cases whateve r te result it is. Shoddy investigation should be given away and a honest investigation should be done to bring all the accused under rule of lawand ounished.

U have made a good point.👍 This is the time our judiciary should activise itself for the protection of the Fundamental rights enshrined under Article 21 of the Constitution which includes not only fair trial but also right to privacy,human dignity and many more. Since the past few years judiciary appears to be ignoring the unawarranted and unscrupulous acts of bureaucrats and police be it Hyderabad encounter, lynching of people, public display of people involved in a protest, custodial deaths, suspension of internet in J&K without any due process of law (as said in Maneka Gandhi's case we follow due process of law and not an arbitrary procedure established by law.) and what not. As you said, it is indeed the need of the hour that people should wake up and make a call to protect the very basic structure of our Constitution i.e. justice which is thwarted by our government and its authorities time and again.

ReplyDeleteहमे समझना होगा कि अगर कोई अपराध हुआ है तो उसका निर्णय अदालत करेगी और अगर वे अपराधी है तब भी पुलिस को एनकाउंटर की आजादी नहीं दी जा सकती और अदालत के फैसले के आधार पर ही सजा दी जा सकती है.भारत के संबिधान में किसी अपराध के लिए न्याय की बात कही गई है,बदले की बात नही कही गई है.
